An IEP, or Individualized Education Program, is a legally binding written plan for a public-school student with a disability that affects their learning. Created under the Individuals with Disabilities Education Act (IDEA), it sets measurable goals and spells out the specialized instruction, related services and supports the school must provide, at no cost to the family.
To qualify for an IEP, your child must have a disability in one of 13 federal categories under IDEA that affects their ability to learn. A 504 plan doesn't require one of those categories -- your child can qualify with any disability that substantially limits a major life activity, such as learning, concentrating, or reading.
IDEA and Section 504 are federal laws, so the core protections apply in all 50 states: the right to a free appropriate public education, to request an evaluation, and to bring an advocate to every meeting. What varies by state is implementation: evaluation timelines, dispute-resolution procedures, and the exact forms and deadlines.
